By using the Site, you agree to be bound by these Terms and Conditions and to use the Site in accordance with these Terms of Service, our Privacy Policy, and any additional terms and conditions that may apply to specific sections of the Site or to products and services available through the Site or from ROCALICENCE.

 

Accessing the Site, in any manner, whether automated or otherwise, constitutes use of the Site and your agreement to be bound by these Terms of Service.

 

By using this Site, you signify your acceptance of this policy. If you do not agree to this policy, please do not use our Site. Your continued use of the Site following the posting of changes to this policy will be deemed your acceptance of those changes.

Article 1a: Age Limit

ROCALICENCE does not permit those under 18 to use the Service. We do our best to restrict access to our sites, products, and services to minors. We target a mature audience capable of understanding the implications and responsibilities of the examination and licensing process.

 

Any subscriber who does not meet the age requirement will be removed from our database as soon as this is brought to our attention. Any booking made by a minor will be cancelled and any fees paid will not be refunded.

 

Article 2: Placing an Order

By placing an Order for examination services through the Service, you warrant that you are legally capable of entering into binding contracts.

 

Article 3: Price

All prices are indicated in Canadian Dollars (CAD). The price of examination services can be changed at any time. However, the price applied to an order will be the one stated at the time of the order.

 

Article 4: Your Information

If you wish to place an Order for examination services available on the Service, you may be asked to supply certain information relevant to your Order including, without limitation, your name, your email address, your phone number, your WhatsApp number, and your payment information.

 

You represent and warrant that: (i) you have the legal right to use any payment method(s) in connection with any Order; and (ii) the information you supply to us is true, correct, and complete.

 

By submitting such information, you grant us the right to provide the information to payment processing third parties for the purpose of facilitating the completion of your order. Your personal information, including your WhatsApp number and phone number, will not be disclosed to any third party except to federal or regulatory authorities upon lawful request. Your contact information is used internally for the purposes of delivering your examination service and for marketing communications as agreed upon at the time of registration.

 

Article 5: Payment

Payment is due immediately on the date of the order. Payment can be made through any of the payment methods available on the Site, including major credit cards and approved online payment methods. Payment cards are subject to validation checks and authorization by your card issuer. If the required authorization is not received, RCLP Inc. will not be liable for any delay or non-delivery of the service.

 

Article 6: Cancellation, Rescheduling, and Exam Attempts

6.1  Non-Refundable Policy

All examination fees are non-refundable under any circumstances. Once a booking is confirmed and payment received, no cash refund will be issued for any reason, including but not limited to visa denial, travel restrictions, illness, change of plans, or any personal or regulatory circumstance.

 

6.2  Rescheduling Credit

(a)  If the candidate provides written notice of cancellation to [email protected] at least fourteen (14) calendar days prior to the scheduled examination date, fifty percent (50%) of the examination fee paid will be held as a non-transferable rescheduling credit applicable toward a future booking only.

 

(b)  The rescheduling credit is valid for twelve (12) months from the original scheduled examination date. No cash refund will be issued under any circumstances.

 

(c)  If cancellation notice is received fewer than fourteen (14) calendar days before the scheduled examination, or if the candidate fails to attend, the full examination fee is forfeited. No credit or refund will be issued. No exceptions.

 

(d)  The rescheduling credit is non-transferable and may only be applied by the original registered candidate toward one future examination booking.

 

6.3  Second Cancellation

The rescheduling credit may be applied to one future booking only. Any cancellation of a rescheduled examination — regardless of notice given — results in full forfeiture of the credit with no further credit or refund issued under any circumstances.

 

6.4  Examination Failure and Re-Testing

In the event that a candidate does not pass the examination, no refund or rescheduling credit will be issued. Examination fees cover one examination attempt only. In accordance with ISED (Innovation, Science and Economic Development Canada) guidelines governing the Restricted Operator Certificate — Aeronautical (ROC-A), no mandatory waiting or cooling-off period is required before re-attempting the examination, although a period of self-directed study is strongly recommended prior to re-booking. A new booking and full examination fee is required for each subsequent attempt. There is no limit to the number of attempts a candidate may make.

 

6.5  RCLP Inc. Cancellation

RCLP Inc. reserves the right to cancel or reschedule an examination at its sole discretion. In such event, the candidate will receive a full credit of the examination fee toward a future booking at no additional cost.

 

Article 7: Physical Presence Requirement

The examination is conducted via Google Meet (or such other platform as designated by RCLP Inc.) and is administered by an ISED-appointed examiner. The candidate acknowledges and agrees that they must be physically located within Canada at the time of the examination. Remote participation from any location outside of Canada is not permitted and will result in cancellation of the examination with no refund or credit issued.

 

RCLP Inc. is not responsible for any inability to travel to Canada for any reason, including but not limited to visa denial, electronic travel authorization (eTA) denial, border restrictions, flight cancellations, or any other personal, legal, or regulatory circumstance. It is the sole responsibility of the candidate to ensure they are legally permitted to enter and remain in Canada at the time of the scheduled examination.

 

Article 8: Regulatory Disclaimer

RCLP Inc. provides the Canadian Restricted Operator Certificate — Aeronautical (ROC-A) examination service only. RCLP Inc. is not a training provider, flight instructor, or educational institution.

 

ISED Canada rules governing the administration, eligibility criteria, and validity of the ROC-A are subject to change at any time without notice. RCLP Inc. accepts no liability for any changes to ISED regulations that may affect a candidate's examination eligibility or certificate validity.

 

It is the sole responsibility of the candidate to verify their current eligibility with ISED, and any other applicable regulatory authority before making a booking or payment. RCLP Inc. accepts no liability whatsoever for: (a) any changes to ISED regulations; (b) any determination of eligibility or ineligibility made by any regulatory authority; (c) any outcome arising from a candidate's application to any regulatory body; or (d) any career, financial, or personal loss arising from reliance on information provided on this website. The entire onus of verifying eligibility and regulatory compliance rests solely with the candidate.

 

Article 9: Limitation of Liability

To the maximum extent permitted by applicable law, RCLP Inc.'s total liability to any candidate in connection with the examination services shall not exceed the total examination fees paid by that candidate for the specific examination booking giving rise to the claim (maximum CAD $113.00 per booking). RCLP Inc. shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of earnings, career delays, travel costs, or any costs arising from failed regulatory applications.

 

Article 10: Changes to These Terms and Conditions

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material, we will make reasonable efforts to provide at least 30 days' notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion. By continuing to access or use our Service after those revisions become effective, you agree to be bound by the revised terms. If you do not agree to the new terms, please stop using the website and the Service.

 

Article 11: Governing Law and Jurisdiction

These Terms and Conditions are governed by and construed in accordance with the laws of the Province of Ontario and the federal laws of Canada applicable therein. Any dispute arising out of or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts of the Province of Ontario, Canada. You irrevocably submit to the personal jurisdiction of such courts and waive any objection to proceedings in such courts on the grounds of venue or inconvenient forum.

You can cancel the SMS service at any time. Just text "STOP" to unsubscribe. After you send the SMS message "STOP" to us, we will send you an SMS message to confirm that you have been unsubscribed.

If you are experiencing issues with the messaging program you can reply with the keyword HELP for more assistance, or you can get help directly at [email protected].

Carriers are not liable for delayed or undelivered messages.

As always, message and data rates may apply for any messages sent to you from us and to us from you. Message frequency varies based on your exam schedule.

Mobile/SMS opt-in data and consent will not be shared with any third parties or affiliates for marketing purposes.
